In response to the show cause notice, reply/affidavit has been filed by respondents No.2 and 3. Learned counsel for respondent No.4 i.e.
Sarpanch of the Gram Panchayat as well as respondents No.2 and 3 jointly state that it was a part of the cleanliness drive in the village that the manure and other waste material lying at the spot was removed. They, however, do not dispute the fact that the petitioner is in actual physical possession of the plot in dispute. They also undertake that until the order to maintain status quo passed by this Court is vacated/modified/varied, the possession of the petitioner over the subject property shall not be disturbed.
In view of the above-stated undertaking and the stand taken by the respondents, no further action is required to be taken in these proceedings which are accordingly dropped.
