This contempt petition has been filed, inter alia, alleging non- compliance of the order dated 12.12.2005 passed in C.W.P.No.19279 of 2005.
A bare perusal of the aforesaid order would reveal that the main grievance of the petitioners in the writ petition was that the Chairman, Mandi Board, Chandigarh is not taking any decision on their representation.
The writ petition was accordingly disposed of with a direction to "the said authority" to take a final decision on the representation.
However, the contempt petition has been filed against the Secretary of the Market Committee as well as Secretaries of Punjab Mandi Board and Punjab Agriculture and Development Department. No direction was issued to these authorities to decide the representation of the petitioners.
Consequently, I do not deem it appropriate to continue with these contempt proceedings which are dropped, however, with liberty to the petitioner to initiate the proceedings afresh against the appropriate authority, if so advised.
