Petitioner Rajwinder Singh apprehending his arrest in a complaint No. 837 of 2004 under Section 138 of the Negotiable Instrument Act, pending before the CJM, Patiala, has filed this petition under Section 438 Cr.P.C. for anticipatory bail.
I have heard counsel for the parties and gone through the contents of the FIR.
Counsel for the petitioner contends that the petitioner is facing the trial in the aforesaid complaint case under Section 138 of the Negotiable Instrument Act and was regularly appearing before the trial Court.
However, on 24.10.2005, the petitioner could not appear because there was some confusion as to where the case was fixed.
Counsel for the petitioner further contends that in view of the order dated 9.11.2006, the petitioner has appeared before the trial Court and has furnished his regular bail bonds, which have been accepted and attested and since then he is regular appearing before the trial Court.
In view of the above, the interim bail, granted vide order dated 9.11.2006 is made absolute.
Disposed of accordingly.
