Petitioner Amar Singh apprehending his arrest in a non- bailable offence in case FIR No. 304 dated 3.10.2006 under Sections 419/420/465/467/471/120-B/225 IPC, registered at Police Station City Moga-I, District Moga, has filed this petition under Section 438 Cr.P.C. for anticipatory bail.
I have heard counsel for the parties and gone through the contents of the FIR.
Counsel for the petitioner contends that as per the allegations in the aforesaid FIR, one Charan Singh stood as a surety to accused Janak Singh for his release on parole for a period of 28 days. The petitioner, who is a Lambardar of the village, had identified said Charan Singh and his property as per jamabandi. It has been alleged that the said co-accused Charan Singh furnished forged jamabandi and wrong address. Counsel for the petitioner contends that the petitioner had identified Charan Singh, who is the genuine person.
Counsel for the petitioner further contends that in view of the order dated 9.11.2006, the petitioner has joined the investigation. This fact has not been disputed by the State Counsel.
In view of the above, the interim bail, granted vide order dated 9.11.2006 is made absolute subject to the same terms and conditions.
Disposed of accordingly.
