The petitioners have approached this Court for issuance of directions to grant the benefit of revised rates of death-cum- retirement gratuity increased from Rs. 1 lac to Rs.2.5 lacs. In this regard, the petitioners have challenged the cut off date fixed by the State Government.

During the course of arguments, Shri Subhash Ahuja, the learned counsel appearing for the petitioners has contended that the claim of the petitioners is covered by a Division Bench judgment of this Court dated September 23,2005 (Annexure P.4) in CWP No.7446 of 2003. Shri Ahuja further informs the Court that for the redressal of the grievance, the petitioners have already served legal notices dated March 7, 2006 and April 3, 2006 (Annexure P.5, collectively) which remain unresponded so far.

In this view of the matter, without going into the merits of the claim made by the petitioner, we dispose of the present petition with a direction to State of Haryana through its Secretary, Department of Finance, Haryana, respondent No.1 to take a final decision on the aforesaid legal notices (Annexure P.5, collectively) within a period of six months from the date a certified copy of this order is received, by passing a detailed and speaking order and keeping in view the judgment (Annexure P.4) or any other judgment which may be relevant for the purposes of the case and take such other appropriate action, as may be required, in accordance with law.

A copy of the order be given dasti on payment of usual charges.
