It is admitted position that petitioner is no longer in possession of the premises.
This is revision petition against the orders whereby injunction application made by Amarjit Kaur, who was originally plaintiff, was allowed. Then appeal filed arising out of that order had been dismissed.
The civil suit filed by Amarjit Kaur is stated to be pending in the court of Additional Civil Judge(Sr.Division) at Panchkula.
In view of the fact that present petitioner is no longer in CR.No.1136 of 2005 #2#
possession of the premises, counsel for the petitioner states that this petition has become infructuous and the same may be dismissed as such. He prays that trial Court be directed to expedite the trial.
Suit was instituted in 2004 and is stated to be pending since then. This petition is accordingly dismissed as having become infructuous with the direction that the trial Court shall expedite the trial and make all out efforts by giving three opportunities to each of the parties to lead evidence and decide the case within a period of one year.
