Notice of motion to the respondents.

On the asking of the Court, Sh. Sukhdip Singh Brar, Additional Advocate General, Punjab accepts notice on behalf of the respondents.

Copies of writ petition have been supplied to the learned counsel for the respondents.

The petitioners have approached this Court making a grievance against Jalandhar Improvement Trust, Jalandhar-respondent no.2 claiming that although the requisite amenities have not been provided by the Trust so far, the petitioners are being required to deposit a sum of Rs.4,49,650/- on account of non-construction fee from 2001 to 2006.

After hearing learned counsel for the petitioners and taking into C.W.P NO.19748 OF 2006 2

consideration the averments made in the present petition, we find that the petitioners have already sent a representation dated July 6, 2006 (Annexure P-7) which remains unresponded so far.

In this view of the matter, without commenting on the various pleas raised by the petitioners in the present petition, we dispose of the present petition with a direction to the Jalandhar Improvement Trust, Jalandhar-respondent no.2 to take a final decision on the aforesaid representation Annexure P-7 within a period of 4 months from the date a certified copy of this order is received by passing a detailed and speaking order and take such further action as may be required in accordance with law.

Copy of the order be given dasti on payment of the usual charges.
