The petitioner along with respondent No.1 filed a suit for declaration claiming ownership regarding the property in dispute.

Respondent No.1 thereafter moved an application that qua him, the suit be dismissed as withdrawn. Despite opposition by the petitioner, application was allowed on 24.1.2001and the suit qua respondent No.1 was ordered to be dismissed as withdrawn and it was further ordered that qua the petitioner, suit shall continue. No action was taken thereafter. Order passed was allowed to become final. Now after four and half years, application to review the same has been moved by the petitioner, which was dismissed by the Court below.

This Court feels that the order passed by the Court below was perfectly justified. No case is made out for interference.

Dismissed.
