Learned counsel for the applicant/appellant states that both the parties in this case are relations inter-se and a compromise has been arrived at between them on December 07,2006. In that behalf, a Compromise Deed Annexure A-1, has been placed on the file. Now learned counsel for the applicant/appellant wants to withdraw the main appeal.
In this view of the mater, C.M.No.8-CII of 2007, is allowed and consequently main appeal bearing F.A.O. No.3096 of 2004 stands dismissed as withdrawn. However, the parties shall be bound by the terms and conditions of Compromise Deed Annexure A-1.
