The prayer made in the application is to fix the case for final disposal since the same is covered by a judgment of this Court dated May 13, 2005 passed in R.F.A. NO. 737 of 2000 (Jaswant Kaur and others Vs. State of Punjab and another).
Notice of the application to the Advocate General, Punjab.
Mr. Sushant Maini, the learned Deputy Advocate General, Punjab, who is present in Court, accepts notice.
R.F.A. No. 1441 of 2000 (O&M) 
The learned counsel appearing for the appellant has produced before me a copy of the judgment dated May 13, 2005, passed in R.F.A. NO. 737 of 2000 (Jaswant Kaur and others Vs. State of Punjab and another).
A perusal of the aforesaid judgment shows that the assessment of compensation in Jaswant Kaur's case (supra) was qua the land which had been acquired through a notification dated April 7, 1989. The perusal of the award of the reference Court in the present appeal also shows that the land in the present appeal has also been acquired through the aforesaid notification dated April 7, 1989.
Consequently, it is apparent that the controversy in the present case is squarely covered by the judgment in Jaswant Kaur's case (supra).
In these circumstances, the main appeal itself is disposed of in terms of the judgment dated May 13, 2005 passed in R.F.A. NO. 737 of 2000 (Jaswant Kaur and others Vs. State of Punjab and another).
C.M. as well as the main appeal stand disposed of.
