Mr. D.S. Patwalia, the learned counsel appearing for the Thapar Institute- respondent No.5 points out that since the academic session 2005-2006 was already over, therefore, no provisional admission can be granted to the petitioners, at this stage. Mr. Patwalia, however, very fairly states that if the C.M. No.22093 of 2005 and

C.W.P. No. 9987 of 2005 (O&M) [2]

petitioners apply for admission in the next academic session then their claim would be considered, in accordance with law.

In view of the aforesaid statement of the learned counsel appearing for the Thapar Institute, the prayer made in the application cannot be granted.

Application is dismissed.

Faced with the aforesaid difficulty, Mr. Jatin Salwan, the learned counsel appearing for the petitioners states that the petitioners would apply afresh to the Director Sports, for the grant of Sports Gradation Certificate and if directions are issued to the Director Sports to consider the claim of the petitioners, for the grant of the aforesaid certificate, then the present writ petition be dismissed as withdrawn.

Mr. Sushant Maini, the learned Deputy Advocate General, Punjab, has no objection to this limited prayer of the writ petitioners being granted.

In view of the aforesaid agreement between the learned counsel for the parties, the present writ petition is dismissed as withdrawn with liberty to the petitioners to apply afresh to the Director Sports for the grant of Sports Gradation Certificate. If any such application is received by the Director Sports-respondent No.2, within a period of two weeks from the day a certified copy of the order is received, then the Director Sports shall consider the claim of the petitioners within a period of six weeks thereafter, in accordance with law and as per the policy of the Department.

The writ petition is accordingly dismissed as withdrawn.

Copy of the order be given dasti on payment of usual charges.
