In pursuance to the directions issued by this Court on 15.9.2004 in C.W.P. No. 18428 of 1991, the petitioner has been paid monetary benefits like GPF, salary from 17.4.2003 to 31.8.2003, leave encashment of 103 days, GIS amounting to Rs. 86,314/-. It has further been submitted that the pensionary benefits like commutation of pension, gratuity and pension have already been given to the petitioner vide order dated 20.5.2005 issued by the Accountant General, Haryana. A copy of the order dated 3.12.2004 has also been placed on record (R-1) to show that the petitioner is not entitled to back wages from the date he was dismissed from service to the date of his reinstatement nor he has been held entitled to allowances during the suspension period except subsistence allowance already paid.
In view of above, nothing survives for determination in these proceedings.
Rule is discharged.
However, the petitioner shall be at liberty to challenge the order Annexure R-1 at an appropriate forum.
