The instant petition has been filed complaining non-implementation of the directions issued by this Court in CWP No.3073 of 2001, as up-held in LPA No.984 of 2002. Mr.Khosla, learned counsel for the respondent has placed on record a copy of the order dated 23.2.2006 passed by Hon'ble the Supreme Court, which is mark 'A'. According to the observations made by the Supreme Court in its order dated 23.2.2006, the matter has been remitted back to the High Court for deciding the rates payable by the petitioner. It has also been stated at the instance of the petitioner that he is willing to deposit the amount @ Rs.2600 per Sq. Yards and he be allotted the plot accordingly subject to the result of the writ petition after remittance by Hon'ble the Supreme Court.
Accordingly, nothing survives for adjudication in these proceedings and the petitioner has to act in accordance with the directions issued by the Supreme Court. Rule is discharged.
