JUDGMENT
The defendant-respondents have stated before the Courts below that they will not excavate the earth from the land of the plaintiff-appellants. In fact, that puts an end to the controversy with regard to grant of interim order. Therefore, both the Courts below have rightly held that no interim direction staying the excavation by the respondents from the land of the co-respondents be granted.
Dismissed.
