Jaswant Singh v. Kuljeet Singh & Ors. - CR-1454-2006 RD-P&H 1510 (7 March 2006)
CR No.1454 of 2006
DATE OF DECISION:16.3.2006
Kuljeet Singh and others.
HON'BLE MR. JUSTICE M.M.KUMAR,
Present:- Mr.Abhishek Sharma,Advocate
for the petitioner.
The instant petition is directed against the order dated 20.7.2005 dismissing the objection of the objector Jaswant Singh-respondent, who is admittedly son of Arjan Singh JD-respondent. The DH-respondent has been shown to be in possession of the property in question. It has also been held by the civil court that the objector-petitioner is not in possession of the suit land.
The executing court cannot certainly go behind the decree to reverse such findings. There is no ground to interfere in the impugned order. The objection petition has been filed by the petitioner is totally frivolous, in order to delay the execution proceedings. Accordingly, the revision petition is dismissed.
