Vide order under challenge, application of the petitioner to implead him as one of the defendants, in the pending suit, filed by the respondent No.1, was dismissed. Merely because, petitioner has entered into an agreement to sell with respondent No.2 is no ground to implead him as a party. Contention of counsel for the petitioner that he has become owner of the property in dispute on the basis of Will, and, as such, he is a necessary party is also devoid of merit because Will is not in dispute in the pending suit. No case is made out for interference.
