Dharam Pal v. Santosh & Ors - CR-1565-2006 RD-P&H 1540 (8 March 2006)
C.R. No. 1565 of 2006
Date of Decision: 21.3.2006
Santosh and others
CORAM: HON'BLE MR. JUSTICE M.M. KUMAR
Present: Mr. Ramesh Sharma, Advocate,
for the petitioner.
The order dated 14.2.2006, passed by the learned trial Court has been made subject matter of challenge in this petition filed under Article 227 of the Constitution. The petitioner has admitted that the cross-examination of Satbir Singh, AW2 has already been conducted and thereafter he has changed his counsel. After engaging a new counsel, an application was filed for recalling the above mentioned witness to confront him with the marriage invitation card and photographs so as to impeach his credibility. Learned trial Court after considering the submissions of the petitioner found that no document is sought to be proved by confronting to marriage invitation card or photographs.
Having heard learned counsel, I am of the view that no injustice has been caused to the petitioner warranting interference of this court in exercise of jurisdiction under Article 227 of the Constitution. The petition is wholly without merit and the same is accordingly dismissed.
