Offence alleged is under sections 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985.
This order will dispose of Criminal Misc. Nos.9105-M and 10089-M of 2006.
Case of the prosecution is that on receiving secret information that the petitioners were indulging in dealing with narcotics, a raid was organized and Sukhdev Singh was arrested on the spot while the petitioners absconded.
Counsel for the petitioners submits that the identity of the petitiones is debatable, as the petitioners were not identified on the spot nor any identification parade was held and they have already been in custody for more than four months; they are not previous convicts and are not likely to abscond or misuse the concession of bail.
Without expressing any opinion on merits, the petitioners are granted bail to the satisfaction of ACJM/ Duty Magistrate, Barnala.
The petitions are disposed of.
