Present: Shri Vikas Singh, Advocate, for the appellants.
Learned counsel for the plaintiff-appellants at the out-set says that the present appeal may be disposed of as not pressed with a liberty to the plaintiff-appellants to approach the authorities for removal of the electric supply cable running over the plot of the plaintiffs.
In view of the statement of the learned counsel for the appellants, the present appeal is disposed of as having not pressed.
However, it is directed that in case the plaintiffs move an appropriate application before the competent authority for removal of the aforesaid electric supply cable running on the plot of the plaintiffs, then the competent authority shall take into consideration the entire facts and circumstances of the case and after visiting the spot shall pass an appropriate order.
While considering the claim of the plaintiffs in the aforesaid R.S.A. No.4034 of 2005
application, the competent authority shall not take into consideration the dismissal of the present suit filed by the plaintiffs.
A copy of this order be given dasti on usual charges.
