Civil Revision No.1181 of 2006
Vide order, under challenge, application of the petitioner, to lead additional evidence, was dismissed. Vide her application, the petitioner intended to bring on record, by way of additional evidence, a demarcation report made by a revenue officer at her instance. It is apparent from the records that earlier also, similar application of the petitioner was dismissed and the order was upheld by this Court.
During arguments, it is brought to the notice of the Court that as Jiwan Lal, Naib Tehsildar (retd.), who was earlier appointed as a Local Commissioner, to demarcate the land, did not carry out the demarcation, the Civil Revision No. 1181 of 2006 - 2 -
SDM has appointed a penal of Kanungos to demarcate the land. This Court feels that in view of dismissal of earlier application for leading additional evidence of the petitioner, the Court below was justified to dismiss his second application for the same relief. No case is made out for interference.
