Petitioner landlord filed a petition for ejectment of the respondent-tenant under Section 13 of the East Punjab Urban Rent Restriction Act, 1949. Ejectment was sought primarily on two grounds; (i) non-payment of rent and (2) the tenant has ceased to occupy the demised premises. The petition was dismissed. Petitioners also failed in appeal. So far as the ground for non-payment of rent is concerned, it has been admitted that the same was paid, after determination by the Rent Controller. As such the said ground for ejectment ceased to exist.
A perusal of the findings given by the Appellate Authority in paras 16 to 29 of the judgment clearly indicates that the petitioners have Civil Revision No.1498 of 2006
the respondent-tenant had ceased to occupy the premises in dispute for a continuous period of four months. There exists no evidence to this extent except the bald statement made by one of the petitioners. Petitioners have not brought on record any evidence regarding non-consumption of the electricity or in the shape of statement made by some adjoining shopkeeper to prove their case. No case is made out for interference in pure findings of fact as counsel has failed to raise any substantial question of law.
Civil revision is dismissed.
