This application has been filed under Section 5 of the Limitation Act for condonation of delay in filing the appeal. Application is accompanied by an affidavit. In view of reasoning given in the application, it is allowed subject to just exceptions and delay in filing the appeal is condoned.
R.S.A. No. 2642 of 2005
Appellant plaintiff filed a suit for permanent injunction with a prayer that the respondents defendants be restrained from interfering in his possession, in the property in dispute, description of which was given by him in his plaint. His suit was dismissed. He also failed in appeal. Both the Courts below, by relying upon evidence on record in the shape of revenue documents, came to a conclusion that the appellant had failed to prove that he was in possession of the property in dispute. In view of findings recorded by the appellate Court below in para No. 11 of the judgment under challenge, no case is made out for inteference in pure findings of fact, as counsel has failed to raise any substantial question of law. Dismissed.
