Through the instant writ petition, the petitioners claim promotion to the post of Assistant Fitter with effect from the date Rohtash son of Shri Dayanand was promoted as such. In fact, the claim of the petitioners is that the petitioners' seniority over the aforesaid Rohtash came to be finalised vide order dated 18.3.2004 (Annexure P1). It is, therefore, that a right accrued to them to claim promotion from the date a person junior to them was promoted against the post of Assistant Fitter.

Learned counsel for the petitioners states that in order to claim retrospective promotion with effect from the date their junior Rohtash was promoted as Assistant Fitter, the petitioners issued legal notices Annexures P3 to P6. It is, however, pointed out that no decision has been taken thereon till date.

Learned for the petitioners states that the petitioners will be satisfied if the instant writ petition is disposed of by requiring respondent CWP NO 4489 OF 2006 2

No.3 i.e. the General Manager, Haryana Roadways, Jind, to take a final decision on the legal notices Annexures P3 to P6.

view of the above, without going into the merits of the claim raised by the petitioner, we consider it just and appropriate to dispose of the instant writ petition by directing respondent No.3 i.e. the General Manager, Haryana Roadways, Jind, to take a final decision on the legal notices Annexures P3 to P6, by passing a well reasoned speaking order within three months from the date of receipt of a certified copy of this order.

Disposed of accordingly.

Order dasti on payment of usual charges.
