It has been stated that the petitioner is younger brother of husband of the deceased. It is allegation against him that he had caught hold of the deceased, who was then set on fire by her husband. Counsel for the petitioner states that during investigation, allegation against the petitioner was found to be false and when final report was submitted in Court, he was put in column No. 2. However, subsequently, vide order dated March 5, 2003, petitioner was summoned as an accused by invoking the provisions of Section 319 Cr.P.C. and since thereafter, he is in jail. It is further stated that the trial will take a long time before it is finally heard and concluded.
Facts, mentioned above, have not been controverted by the State counsel on getting instructions from ASI Surinder Singh.
However, prayer for bail has been opposed.
Without expressing any opinion on merits of the case, this petition is allowed and during pendency of the trial, Vijay Kumar, petitioner, is directed to be released on bail to the satisfaction of the trial Court.
