Vide order dated 3.1.2006, application of bail of the petitioner was allowed by the Court below subject to the following conditions:- "(a) That the accused applicant shall not leave the country without prior permission of the Court and he shall surrender his passport, if any, in the court.

(b) That the accused applicant shall not tamper with the prosecution evidence or influence the witnesses.

(c) That the accused applicant shall return Rs.2.00 lakh to the complainant within two months from today as agreed failing which the complainant/ prosecution will be at liberty to move an application for cancellation of his bail." This application has been filed by the petitioner on the ground that the condition regarding deposit of Rs.2 lacs has wrongly been passed by the Court below.

A perusal of record reveals that dispute is only regarding Rs.2 Crl. Misc. No.12881-M of 2006 [2]

lacs. Counsel for the petitioner states that it is yet to be gone into as to whether the compromise was actually and in fact was executed by the petitioner or not. In view of this, this Court feels that the condition imposed was not justified. Accordingly, this application is allowed and Condition `C' in the order dated 3.1.2006 vide which bail was granted stands removed.
