FIR was recorded on 14.2.2003 against the petitioners alongwith one Balwant, who is husband of the complainant- respondent No.2. Against them, charge sheet was framed on 4.3.2004. Petitioners, alongwith said Balwant, went in revision, which was dismissed vide order dated 31.1.2006 (Annexure P/5), by the Court below. Prayer in this application is to quash FIR, charge sheet and the order passed by the revisional Court. After hearing counsel for the petitioners, this Court feels that no case is made out for interference, in view of findings given by the Court below in paragraph No.10 of its judgment dated 31.1.2006.
Dismissed. However, keeping in view of age of petitioner No.1 and a fact that other petitioners are living separate from said Balwant, it is ordered that during pendency of trial, personal appearance of the petitioners shall remain exempted, except when their presence is specifically asked by the trial Criminal Misc. No.17743-M of 2006 - 2 -
Court. It is further made clear that the petitioners shall not raise any objection in recording of evidence in their absence.
