Vide order, under challenge, respondent was allowed to lead evidence. It is apparent from the records that at an earlier point of time, respondent was ordered to be proceeded ex-parte, however, subsequent thereto he joined the proceedings and allowed to cross examine witnesses produced by the petitioner. This Court feels that as defence of respondent was not struck off, as such, he is entitled to participate in the proceedings subsequent to his joining in the pending suit, before the Court below. In view of this, order passed is perfectly justified. No case is made out for interference. However, keeping in view facts and circumstances of this case, it is ordered that the respondent be granted three opportunities within a span of four months, by giving dates after short intervals.
Revision petition stands disposed of.
