During the course of arguments, the learned counsel appearing for the appellant, on instructions from widow of Dharam Singh (the original plaintiff, who has since died), states that the main suit filed by the plaintiff be permitted to be withdrawn with liberty to the plaintiff to seek remedies in accordance with law and also with a liberty to defend the possession in all proceedings which may be initiated by the defendants, by taking defences in accordance with law.
Mr. Sushant Maini, the learned Deputy Advocate General, Punjab, has no objection to the aforesaid limited prayer of the plaintiff being allowed.
R.S.A. No. 1503 of 2001 
In view of the aforesaid fact, the main suit filed by the deceased plaintiff- Dharam Singh is permitted to be withdrawn, with liberty as aforesaid.
Since the main suit has been permitted to be withdrawn, therefore, the present appeal has been rendered infructuous and is disposed of accordingly.
