Through the instant writ petition, the petitioner claims benefit of family pension as well as monetary benefits under the ex-gratia scheme.

The same benefits were also sought by legal notice dated February 03, 2006 (Annexure P-1). It is, however, contention of the learned counsel for the petitioner that no decision has been taken by the respondents on the aforesaid legal notice dated February 03, 2006. Learned counsel for the petitioner further contends that the petitioner would be satisfied if the instant writ petition is disposed of by requiring respondent no.2 i.e.

Superintending Engineer, Department of Public Health, Rewari Circle, Rewari, Haryana to take a final decision on legal notice dated February 03, 2006.

In view of the above, without going into the merits of the claim raised by the petitioner, we consider it just and appropriate to dispose of the C.W.P.No.5034 of 2006 : 2 :

instant writ petition by directing the respondent no.2 i.e. Superintending Engineer, Department of Public Health, Rewari Circle, Rewari, Haryana to take a final decision on the legal notice dated February 03, 2006, by passing a well reasoned speaking order within three months from the date of receipt of a certified copy of this order. In case the petitioner is found entitled to any monetary benefits, the same shall be calculated and released to the petitioner within a further period of one month.

Disposed of, accordingly.

Order dasti on payment of usual charges.
