Coram:- Hon'ble Mr.Justice J.S. Khehar.

Hon'ble Mr. Justice P.S. Patwalia

Present: Mr. I.P. Goyat, Advocate

for the petitioner.

Mr. Harish Rathee, Sr. DAG, Haryana

for respondents No.1 to 3.

J.S. Khehar, J. (Oral).

Through the instant writ petition, the petitioner has impugned the order dated 13.1.2005, wherein, the claim of the petitioner for allotment of Route No.68 of district Hissar from Tohana to Brawl via Gajuwala, has been denied to him. Additionally, the petitioner has also been denied the additional route sought by him.

We have examined the issue in hand in the light of the assertions made in paragraphs 7 and 8 of the joint written statement filed on behalf of respondents No.1 to 3, wherein, it has been asserted, that in case, the petitioner is dissatisfied, it is open to him to move an application for the aforesaid route, as well as, its extension, before the Committee headed by the State Transport Controller, Haryana.

CWP No. 2899 of 2005 Page numbers

In view of the above, we consider it just and appropriate to dispose of the instant writ petition by directing the respondents to place the claim of the petitioner before the Committee head by the State Transport Controller, Haryana, for the adjudication of the issue raised by the petitioner. The petitioner is also granted liberty to place any further material, as it may desire, before the aforesaid Committee, within two weeks from today. The issue shall be examined and disposed of by passing a well reasoned speaking order, within two months from the date of receipt of a certified copy of the instant order alongwith the application, if any, filed by the petitioner.

Disposed of accordingly.
