The prayer made by the petitioner in this petition filed under Article 226 is for issuance of a direction to the respondents to charge simple interest from him at the rate stipulated in the allotment letter on all types of outstanding dues from the date of allotment. It is an admitted position that the petitioner was allotted a residential plot No.293-P, Sector 5, Urban Estate, Karnal on 18.9.1992. In the reply, respondent Nos.2 and 3 have taken the stand in the preliminary objection that simple interest can be charged with effect from 1.9.2000 as this policy to that effect has been issued on 22.9.2000. Except the afore-mentioned period, the petitioner is legally and contractually bound to pay the amount as per the terms of the allotment letter.
Learned counsel for the petitioner states that in view of the stand taken in the preliminary objection 1 that simple interest shall be charged with effect from 1.9.2000, the writ petition may be disposed of.
