JUDGMENT
The subject matter of challenge in this petition is the order dated 3.7.1998 (P-5). A perusal of the order shows that the petitioner was reverted from the post of Assistant Black Smith to that of Helper, after issuance of a show cause notice. It has been found that the petitioner lack necessary qualification of Middle pass as prescribed by the rules known as the Haryana Transport Department (Group C) Rules of Haryana Roadways,
1995. As the promotion given to him on 27.8.1997 was found to be contrary to the Rules, therefore, the reversion order was passed.
When the matter came up for consideration on 17.7.1998 it was adjourned to 10.8.1998 and thereafter the Division Bench passed an order dated 10.8.1998, observing that as and when the counsel for the petitioner files an application for fixing the case for motion hearing, the same would be put up. A period of more than 7 years has gone by but no application has been filed. Even otherwise we are satisfied that the impugned order dated 3.7.1998 (P-5) does not suffer from any legal infirmity warranting interference of this Court.
Accordingly, the writ petition fails and the same is dismissed.
