On 20.10.2005 CWP No. 16679 of 2005 filed by the petitioners was disposed of by granting liberty to the petitioners to make a representation to the respondents for allotment of alternative site to them. The petitioners have filed the instant petition again with the grievance that their sites have been demolished on 17.1.2006 without any show cause notice or opportunity of hearing. The claim made by the petitioners is that they are sitting on the site on the basis of payment of teh bazari for the last 20/30 years.

After hearing the learned counsel, we are of the view that the matter has already been decided by a Division Bench of this Court when the petitioners filed CWP No. 16679 of 2005 decided on 20.10.2005. The Division Bench has taken notice of the grievance made by the petitioners and the writ petition was permitted to be withdrawn by granting liberty to the petitioners to file a representation for allotment of alternative site to them. The representation was to be considered sympathetically keeping in view that the petitioners were carrying on their business on payment of teh bazari for the last 20/30 years. Therefore, no second petition on the same cause of action would be competent.

There is no merit in this petition and the same is dismissed.
