The prayer in this petition is to release the petitioner on regular bail in FIR No.24 dated 24.2.2004, under section 302, 120-B, 148, 149 IPC, registered at Police Station Morinda, District Ropar.
On January 27, 2006, the prosecution made a statement that one of the vital witness, namely, Dr. Darshan Singh who had conducted the post mortem on the dead body of the deceased, was yet to be examined. The case was, accordingly, adjourned to enable the prosecution to examine the said witness and to produce his statement.
Dr. Darshan Singh has been examined on March 31, 2006 and a certified copy of his statement has been produced which has been perused.
Learned State Counsel, on instructions from ASI Mehma Singh, further informs that only 3-4 formal witnesses are yet to be examined by the prosecution for which the case is now fixed on May 13, 2006.
Having regard to the fact that the trial is at the verge of conclusion and the remaining witnesses can be examined on the date already fixed, this petition is disposed of with a direction to the learned trial court to make an endeavour to record the statements of the remaining prosecution witnesses on the already fixed date, i.e. May 13, 2006, and thereafter to conclude the trial on or before May 31, 2006.
