C.W.P. No. 17079 of 2004
Date of Decision: 01.05.2006
State of Haryana & others
CORAM: HON'BLE MR. JUSTICE M.M. KUMAR
HON'BLE MR. JUSTICE M.M.S. BEDI
PRESENT: Mr. Manoj Kumar Sangwan, Advocate, for the petitioner.
Mr. Harish Rathee, Sr. DAG, Haryana,
for the respondents.
M.M. KUMAR, J. (Oral)
In the connected matter, namely, C.W.P. No. 2269 of 2004, learned counsel for the petitioner has placed on record instructions dated 16.3.2006, showing that the Scheduled Caste employees are to be entitled to accelerated seniority as a consequence of promotions under the reservation policy. The aforementioned position is to come into force with immediate effect and is to have prospective effect only.
As the main prayer in the writ petition made by the petitioner was with regard to implementation of the 86th Amendment of the
Constitution, we find that the aforementioned prayer has now been rendered infructuous. Accordingly, we dismiss the writ petition as having been rendered infructuous.
