At the time of arguments, it has been brought to the notice of the Court by the State counsel that after registration of FIR, subsequently offence under Section 326 IPC was also added in the same. On request made by Shri Sharma, it is ordered that in the heading and of the petition, Section 326 IPC be also read.
It is not in dispute that the petitioners are in jail w.e.f.
September 26, 2005. Counsel states that it will take a long time before trial is finally heard and decided. These facts have not been controverted by the State counsel on getting instructions from ASI Gurmej Singh.
Without expressing any opinion on merits of the case, this petition is allowed and during pendency of the trial, petitioners are directed to be released on bail to the satisfaction of Chief Judicial Magistrate, Muktsar.
