Counsel for the petitioners states that the petitioners have joined the investigation. It has further been stated that at the time of the alleged occurrence, three of the petitioners, namely, Charanjit Singh, Jarnail Singh and Kashmir Kaur, also received injuries, which were declared grievous in nature. To say so, photostat copy of the medico legal reports and opinion given by the Doctors, after X-Ray, have been shown to this Court. It has been stated that as the police is siding with the opposite party, even their statement has not been recorded. Counsel for the petitioners further states that it is yet to be gone into as to which party was the aggressor. Prayer for anticipatory bail has vehemently been opposed by Shri Vipan Mahajan, Advocate, for the complainant and Shri Narender Kapoor, AAG, Punjab.
Without expressing any opinion on merits of the case, this petition is allowed and the order dated March 28, 2006, is made absolute, subject to petitioners' continuing to join the investigation and complying with the provisions of Section 438 (2) Cr.P.C.
