An application under Order 7 Rule 11 CPC moved by the petitioners having been dismissed by the learned Additional Civil Judge (Sr.
Division), Hisar, they have approached this Court under Article 227 of the Constitution of India. A perusal of the impugned order reveals that the respondent-plaintiff, who is a widow, has sought the main relief with regard to declaration of her title over the suit land which is admittedly in her possession. The cancellation of the sale deed is a consequential relief based upon the allegation of fraud, etc. If the substantive relief sought by her is found worth acceptance, other relief shall follow as a necessary consequence.
For the reasons afore-mentioned, the learned Civil Court has rightly held that the respondent-plaintiff is not liable to pay ad valorem court fee at this stage.
