Defendant is the petitioner before this Court. Along with the suit, the plaintiffs filed an application under Order 39 Rules 1 and 2 of the Code of Civil Procedure praying for ad-interim injunction against the defendant. The ad-interim injunction was declined by the learned trial court.
The matter was taken up in appeal by the plaintiffs. The appellate court vide order dated November 28,2003 allowed the aforesaid appeal of the plaintiffs and the defendant was restrained from ousting the plaintiffs from specific portion/number of land in question without getting the same partitioned.
The present revision petition was admitted on February 5,2004 and the parties were directed to maintain status quo regarding possession.
It is apparent that the aforesaid interim order has remained operative for a period of more than two years. In these circumstances, it would be wholly inappropriate to vacate/modify the aforesaid order, at this stage.
Consequently, the present revision petition is disposed of and it is directed that the parties to the suit shall maintain status quo regarding possession during the pendency of the proceedings before the learned trial court. However, the trial court is directed to dispose of the main suit as expeditiously as possible.
