CRM NO.18718 of 2006

Application is allowed, document annexed with it is taken on record.

Criminal Misc. No.17196 M of 2006

This petition has been filed under Section 482 Cr.P.C. with a prayer to quash order dated 6.3.2006 (Annexure P/6) vide which application of the petitioner for re-investigation/ further investigation was dismissed by the Court below.

It is apparent from the record that FIR in this case was registered in the year 1993. At every step, initially when FIR was recorded and subsequent thereto when challan was presented, parties have tried their level best to see that the trial should not proceed further. Many petitions were filed in this Court and matter had even gone upto Hon'ble the Supreme Court. While dismissing the present application, it has specifically been held by the Court below that the petitioner has failed to satisfy the Court as to on which aspect of the matter, further investigation was needed. This case is pending adjudication for the last more than 13 years. Aat one time in CRM No.24429-M of 1999 on 13.9.1999, this Court granted liberty to the petitioner to move an application and to satisfy the Court below regarding his prayer for further investigation. In consequent to that order, petitioner did nothing and kept mum for about two years. He moved the present application only on 16.10.2001. In view of his conduct, he is not entitled to any relief from this Court, while exercising extra ordinary jurisdiction under Section 482 Cr.P.C.

This Court feels that the order passed by the Court below is perfectly justified. No case is made out for interference.

Dismissed.
