This appeal has been filed against order dated 11.4.2005 vide which election petition filed by the appellant was dismissed. The Tribunal below, on perusal of evidence has rightly held that the appellant has failed to make out any case for recount of the votes. It has also come on record that during the process of counting and even thereafter, no application was moved by the appellant to the Presiding Officer regarding alleged malpractices, which he has now alleged in the election petition.

No case is made out for interference in pure findings of fact by the Tribunal below.

Dismissed.
