This order would dispose of two petitions, mentioned above, filed under Section 439 of the Code of Criminal Procedure for granting bail to the petitioners in case First Information Report No.290 dated 11.9.2005 under Sections 148 / 302 read with Section 149 of the Indian Penal Code and Section 25 of the Arms Act registered at Police Station Sadar, Bahadurgarh.

Ld. Counsel for the petitioners contends that Rajinder, Criminal Miscellaneous No.17649-M of 2006 and Criminal Miscellaneous No.23717-M of 2006.

Tek Ram and Ramesh Kumar (co-accused) were granted bail in this case vide order dated 21.3.2006 passed by Hon'ble Mr.Justice Adarsh Kumar Goel. Each of them was holding `Lathi'.

He further contends that Raj Kumar and Hari Dass (petitioners), who have now applied for bail, were also holding `Lathis'. No individual injury to the deceased has been attributed to them.

They are in custody since September 2005. Challan has been put in the Court. Charge as yet has not been framed. The conclusion of the trial, therefore, would take considerable time.

Without expressing any opinion on the merits of the case, these petitions are allowed and Raj Kumar and Hari Dass (petitioners) are granted bail in this case on their executing bonds to the satisfacti9on of the Chief Judicial Magistrate/ Duty Magistrate, Jhajjar.
