J.S.Khehar, J. (Oral) :

The primary grievance of the petitioner relates to the non- payment of retiral benefits to him. In so far as the aforesaid primary grievance is concerned, it emerges from the pleadings of the instant writ petition, that the same is based on the final outcome of departmental proceedings initiated against the petitioner under the provisions of Punjab Civil Services (Punishment and Appeal) Rules, 1970.

Learned counsel for the respondents states, that the departmental proceedings being conducted against the petitioner, which have not been completed as of now, will be completed and finalized within two months from today, subject to the condition that the petitioner co- C.W.P.No.16902 of 2003 : 2 :

operates with the respondents regarding finalization of the same. He further states that on the completion of the departmental proceedings, the issue pertaining to the payment of retiral benefits to the petitioner, shall be disposed of within a further period of one month.

In view of the above, the respondents are directed to complete all the departmental proceedings initiated against the petitioner under the provisions of Punjab Civil Services (Punishment and Appeal) Rules, 1970, within a period of two months from today, and thereupon, calculate and release all retiral benefits payable to the petitioner within a further period of one month.

Disposed of, accordingly.

Order dasti on payment of usual charges.
