J.S.KHEHAR, J. (Oral)

The petitioner claims appointment against the post of Science Mistress (Non-Medical). It is not a matter of dispute that qualification of the post of Science Mistress (Non-Medical) was depicted in the advertisement issued by the authorities on 28.6.2001 inviting applications for the post under reference. The qualification depicted in the aforesaid advertisement is being extracted hereunder:- "e) Science Non-Medical Masters/ Mistresses B.Sc., B.Ed./B.T.

from any recognized University. In B.Sc. there should be Physics, Chemistry and Mathematics."

Learned counsel for the petitioner vehemently contends that the petitioner possesses the qualification of M.Sc., B.Ed. and as such should be treated as qualified for appointment to the post of Science Mistress (Non-Medical).

CWP No.15333 of 2003 [2]

In order to ascertain whether or not the petitioner fulfills the qualification stipulated in the advertisement, we required the petitioner to inform us, whether in B.Sc. qualification possessed by her, she had qualified with Physics, Chemistry and Mathematics. Learned counsel for the petitioner very fairly states that she had acquired the qualification of B.Sc. only with the subject of Chemistry, and that, she had not qualified the same with Physics and Mathematics.

In view of the above, it is clear that the petitioner does not fulfill the qualifications stipulated in the advertisement for the post of Science Mistress (Non-Medical).

For the reasons stated above, we find no merit in the instant writ petition and the same is dismissed.
