The father of the petitioner is stated to have died during his employment with the respondents on 28.1.2000. It would be pertinent to mention that the father of the petitioner was engaged as a Helper Cleaner in the office of respondent No.5. Through the instant writ petition, the petitioner claims compassionate appointment under the ex gratia scheme.

For the aforesaid purpose, he is stated to have submitted an application dated 29.11.2000 (Annexure P1) followed by a legal notice dated 17.8.2005 (Annexure P2). It is, however, pointed out that no decision has been taken thereon till date.

Learned counsel for the petitioner states that the petitioner will be satisfied if the instant writ petition is disposed of with a direction to respondent No.3, to take a final decision on the aforestated application and the legal notice submitted by the petitioner.

Notice of motion.

On our asking, Mr. Ashok Aggarwal, Additional Advocate General, Punjab, accepts notice on behalf of respondents Nos.1 to 5.

Learned counsel for the respondents states that he has no objection to the disposal of the instant writ petition in terms of the prayer made by the learned counsel for the petitioner.

In view of the above, the instant writ petition is disposed of with a direction to respondent No.3 i.e. the Superintending Engineer, Kandi Canal Circle, Hoshiarpur, requiring him to take a final decision on the application dated 29.11.2000 and the legal notice dated 17.8.2005 (Annexures P1 and P2 respectively, with the writ petition) by passing a well reasoned speaking order within three months from the date of receipt of a certified copy of this order.

Disposed of accordingly.

Order dasti on payment of usual charges.
