Mr.Karan Nehra, learned counsel for the petitioner has brought to our notice that the Building Bye laws have since been amended and the petitioner would approach the respondents-authorities with a revised plan in accordance with the revised/ amended Bye-laws.
Learned counsel further states that the present writ petition be disposed of with the aforesaid liberty to the petitioner.
In view of the aforesaid request made by learned counsel for the petitioner, the present writ petition is disposed of with a liberty to the petitioner that if within a period of two months from the date a certified copy of this order is received, the petitioner applies through a revised building plan under the amended Bye laws before the competent authority, the request of the petitioner for the grant of necessary sanction shall be considered by the competent authority, in acordance with law.
The present writ petition is disposed of with a direction that if the petitioner files a revised sanctioned plan within the stipulated period, the interim order dated August 12,2005 shall continue to operate, till the final decision is taken by the competent authority.
A copy of this order be given dasti on payment of usual charges.
