The petitioner is in custody for the last three months.
Allegation against her is that she intoxicated her co-passenger Rekha and committed theft of her chain, topus, diamond ring, Rs.300/- and documents. Rekha became unconscious and was admitted to a hospital.
About this incident, she told her sister, who was at Delhi and who had seen her off at the time of boarding of the train for Bombay.
Without expressing any opinion on merits, no case is made out for grant of bail at this stage. However, if the prosecution evidence is not recorded within three months from the date fixed i.e., 21.2.2006, for reasons not attributable to the petitioner, she will be granted bail by the trial court on such conditions as may be considered to be appropriate by the trial court.
The petition is disposed of.
