CORAM: HON'BLE MR. JUSTICE M.M. KUMAR
HON'BLE MR. JUSTICE M.M.S. BEDI
PRESENT: Mr. HN Khanduja, Advocate for the petitioner Mr. Harish Rathee, Sr. DAG Hy.
The petitioner has approached this Court for payment of G.P.Fund alongwith interest by quashing the order dated 12.8.2005 ( Annexure P.7). According to the afore-mentioned order, the petitioner was under suspension w.e.f. 17.6.2001, the interest was allowed upto June, 2001. The contributions for the period under suspension i.e. from July 2001 to May, 2003 were released without interest and reliance has been placed on Rule 13.9(1) of the Punjab Civil Service Rules, Volume II. However, learned State counsel has stated that the interest has now been paid which comes to Rs. 6294/- even in respect of the afore-mentioned period. In that regard a copy of the order dated 1.2.2006 has been placed on record, which is marked "A". Mr. Rathee further states on instructions from Shri Harish Mehta, Sectional Officer office of Accountant General, Haryana that all dues including arrears of G.P.Fund with interest have been paid.
In view of the above, nothing survives for adjudication in this petition as the necessary relief claimed in the petition has been granted to the petitioner. The writ petition is therefore dismissed as having been rendered infructuous.
