The prayer made in this petition is for issuance of direction to the respondents to pay to the petitioner patient care allowance which has been allowed to some of the similarly situated employees by the respondents.
In response to the notice of motion, the primary stand of the respondents in para 7 of the written statement is that such a relaxation has been granted only to those combatised hospital staff of CRPF who have moved the Courts of law for payment of patient care allowance and the Courts have passed orders in favour of those petitioners.
On our query , the learned counsel for the respondents has not been able to point out to any policy, rules, regulations or instructions which may permit the grant of patient care allowance to the petitioner.
In view of the above fact, we direct the respondents to consider the instant petition alongwith annexures as a representation and decide the same within a period of four months from the date a certified copy of this order is supplied to them. In case anything is found due to the petitioner, the same shall be disbursed to him without any further delay.
Copy of the order be given dasti on payment of usual charges.
