Gram Panchayat has filed this writ petition seeking issuance of a writ in the nature of mandamus directing the respondent-State to hand-over the amount of grant sanctioned by it for construction of stadium in the memory of Shaheed Abdul Hameed.

At the time of arguments, Mr.P.S.Chhinna, the learned State Counsel, states that initially respondent No.3 was authorised to spend the amount of grant. However, subsequently, this authority was withdrawn from him and the amount is now lying with the Deputy

Commissioner, Amritsar, respondent No.2 and he was instructed to nominate the executing agency, which is to execute the construction work. He further states that it is agreed between the parties that now the amount will be handed over to the Gram Panchayat , who will spend it on construction under the direct supervision of the Executive Engineer, Panchayati Raj. He will also intimate the Gram Panchayat the name of the source from whom the material has been purchased and the Gram Panchayat shall collect it from the said purchaser. The remaining amount will be spent by the President of the committee, respondent No.3 on construction to be executed under the direct supervision of the Gram Panchayat.

Mr.Gill states that if the accounts are submitted by the President of the Committee, respondent No.3, Gram Panchayat shall raise no dispute regarding the same.

With the above directions, the writ petition stands disposed of.
